Subletting your home
If you are a lessee and let your home to someone else, then this is called subletting. Under the terms of the lease, you are required to register all sublets within 21 days of the sublet commencing.
If your home is to be sublet, we require you to send us:
- A certified copy of the tenancy agreement with the sub-tenant
- A registration fee of £30
- An alternative mailing address so that the accounts (and any other formal notices) can be sent directly to you
- Details of any managing agent
- A contact number for you and your managing agent, if you have one, in case an emergency arises.
Please note that this requirement applies whether the property is sublet to an individual or to an organisation such as a company, a registered social landlord or a housing association.
If an existing tenancy agreement with your sub-tenant is renewed you will not need to pay a further registration fee. In this case, we only require a certified copy of the renewal of the tenancy.
You need to be aware of your legal obligations for servicing gas appliances.
CityWest Homes through its lettings agency CityWest Homes Residential is able to provide a high quality alternative to help you manage your property yourself or through a commercial lettings agency.
For more information please check the CityWest Homes Residential website: www.cwhr.co.uk.
Short letting
If you are a lessee of Westminster City Council, then short letting your home, letting your property for less than 90 days is a breach of the terms of your lease.
You would also need planning permission to let your property for less than 90 days and without it you are breaking the law and you could be fined up to £20,000.
The future sale of your property could be affected as any enforcement notice will be registered as a legal charge and may deter future buyers.
For further information on planning enforcement check the relevant page of the Westminster City Council's website.
